1. Who we are

Games & Bytes Co is a registered business name of Ensphere Pty Ltd (ABN 51 133 093 071), based in Brisbane, Queensland, Australia. In these terms, "we", "us" and "our" mean Ensphere Pty Ltd trading as Games & Bytes Co. "You" means the person using our website or placing an order.

These terms apply when you use gamesandbytes.com.au or buy from us. Please read them with our other policies:

2. Your rights under the Australian Consumer Law

Nothing in these terms excludes, restricts or changes any right or remedy you have under the Australian Consumer Law (ACL) or any other law that can't be excluded.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

3. Who can buy

To place an order you must be able to enter into a binding contract. If you are under 18, please have a parent or guardian place the order.

Adult humour (18+). Our designs are geeky, cheeky humour, and some (our Spicy range) contain adult innuendo. Our Spicy range designs are intended for adults aged 18 and over. Most designs also come in a clean version. By ordering a Spicy design, you confirm that you are 18 or over, or that you're buying it for an adult.

4. Our products

We sell print-on-demand graphic tees with geeky, cheeky humour designs. Most items are made to order by our print partners after you buy, which is why there's a short production time before dispatch (see our Shipping Policy).

Colour and print. Screens show colours differently, and print-on-demand printing can vary slightly from batch to batch. Small differences in shade or placement are normal. The design printed on your item will be the design shown on the product page. If what arrives is clearly different, that's on us; see our Refund & Returns Policy.

Sizing. Each product page names the blank used and links to our Size Guide. Garment makers allow a small tolerance on measurements.

Model images. Some product images use digitally generated models to show how a design looks when worn. They are not real customers. The print shown in those images is the print supplied, on the blank named on the product page.

Origin. Each product page states where the item is printed and where the blank garment was made. We don't describe our products as "Australian made".

5. Prices and payment

All prices are in Australian dollars (AUD) and include GST.
Shipping costs are shown before you pay, at the latest at checkout. We don't add hidden fees. See our Shipping Policy.
We accept payment through the methods shown at checkout, which may include Shopify Payments (card, Apple Pay, Google Pay), PayPal and buy-now-pay-later services such as Afterpay. Payments are processed by these providers; we never see or store your full card number.
If you use a buy-now-pay-later service, its own terms apply to your repayments.

Pricing errors. We work hard to get prices right. If a price is clearly wrong because of an obvious error (for example, a missing digit), we'll contact you before we make or dispatch your order. You can then choose to go ahead at the correct price or cancel for a full refund. If the error is in your favour and isn't obvious, we'll honour the price you paid.

6. Orders

Accepting your order. Your order is accepted, and a contract is formed, when we send you an order confirmation email.
When we may cancel. We may cancel an order before it's made, with a full refund, if the item is unavailable, a print partner can't make it, there's an obvious pricing error (see section 5), or we reasonably suspect fraud. We'll tell you as soon as we can.
Changing or cancelling. Because items are made to order, production starts soon after you buy. If you need to change or cancel, contact us within 2 hours of ordering. Once production has started we may not be able to change the order, but your ACL rights still apply.
Availability. Products, colours and sizes may sell out or be withdrawn. Showing a product on our site doesn't guarantee it's available.

7. Our designs and content

All designs, artwork, slogans, photos, text and other content on this site are owned by or licensed to Ensphere Pty Ltd, and are protected by copyright and other intellectual property laws. Buying a product gives you the item itself. It doesn't give you any rights to the design.

You may not copy, reproduce, print, sell or otherwise reuse our designs or content without our written permission. Sharing photos of yourself wearing or using our products is welcome.

Our designs are original humour and parody. We are not affiliated with, sponsored by or endorsed by any game, console, software or entertainment brand.

8. Using our website

When using our site, please don't:

break any law, or use the site for fraud;
interfere with the site's security or operation, or try to access parts of it you aren't meant to;
scrape, copy or harvest content or data in bulk;
post content that is unlawful, abusive, defamatory, or infringes anyone's rights.

We may restrict access for anyone who seriously or repeatedly breaches this section. This doesn't affect any order already accepted or your ACL rights.

9. Reviews

We welcome honest reviews, good and bad.

Reviews must be genuine and based on your own experience with the product.
We don't write fake reviews, and we don't pay for or reward reviews unless we say so clearly next to the review.
We don't hide, delay or remove reviews because they're negative. We only remove reviews that are unlawful, offensive, contain personal information, are spam, or aren't about the product or our service, and we apply this the same way to positive and negative reviews.
By posting a review, you allow us to display it on our website and social channels with your first name or display name.

10. Liability

To the extent permitted by law, we are not liable for loss or damage that isn't reasonably foreseeable, or that isn't caused by our breach of these terms, our negligence or a failure to meet a consumer guarantee.

Nothing in this section limits your rights under the Australian Consumer Law or our liability for anything that can't lawfully be limited.

We don't ask you to indemnify us.

11. Third-party links and services

Our site may link to other websites and use third-party services (such as payment and delivery providers). Those services have their own terms and privacy policies.

12. Changes to these terms

We may update these terms from time to time, for example to reflect changes in law or in how we operate. We'll post the updated terms on this page with a new "Last updated" date. The terms that apply to your order are the ones shown when you placed it. Changes won't apply to orders already placed.

13. Governing law

These terms are governed by the laws of Queensland, Australia. You and we can bring proceedings in the courts of Queensland or any other Australian court that has jurisdiction. This doesn't stop you using a consumer protection agency or tribunal in your own state or territory.
